Privacy Policy

Wash Up, LLC ("WashUp," "we," "us," "our") provides car wash operations management software. This policy explains what personal information we handle, why, who we share it with, and the choices you have. It applies to washup.solutions and to the WashUp application at app.washup.solutions.

This policy forms part of the agreement our customers accept when they subscribe. Your use of WashUp is also subject to our Terms of Use at https://www.washup.solutions/terms-of-use.

We do not sell personal information, and we do not run advertising campaigns targeting individuals. Our marketing website uses analytics and marketing tools; the WashUp application does not track you.

1. The two roles we play

WashUp handles personal information in two capacities, and different rules apply to each.

Where we decide how information is used. People who sign up for WashUp, evaluate it, contact us, or administer an account — their contact details, credentials, billing information, and correspondence with us. This policy governs that information.

Where we act on a customer's instructions. Our customers are car wash operators. They use WashUp to run their businesses, and place information into the platform about other people:

  • their own employees and team members, and
  • members of the public named in vehicle damage incident reports.

For that information, the car wash operator decides what is collected and why. We process it to provide the service and follow their instructions. Their own privacy practices govern it, and our commitments to them are in section 14.

If you are an employee of a car wash that uses WashUp, or a customer of one, contact that business first. You can also reach us at section 15 and we will route your request to them.

2. Information we handle

2.1 People with WashUp accounts

Account creation requires a name, email address, phone number, and password. Users may also provide a last name, profile photo, and display preferences. As a consequence of the account existing, we hold the person's role, the company and locations they can access, their notification preferences, and records of when they last signed in and were last active.

Where a numeric access code is used, we store only a one-way cryptographic hash of it, never the code itself.

2.2 Employees and team members of our customers

Our customers use WashUp to run their operations. The information they place in the platform about their staff includes contact and identity details, work schedules, shifts and time off, task and inspection activity, incident reports they filed or were assigned, notes and comments they wrote or that others wrote about their work, messages and calls in the in-app chat, and photos and video they upload.

2.3 Members of the public named in incident reports

When a car wash records a vehicle damage claim, its staff enter information about the person making the claim: their name and contact details, whether they hold a membership, identifying information about the vehicle including its VIN and license plate, and the circumstances of the incident.

These individuals do not have WashUp accounts and do not use our software. Their information is entered by the car wash, which is responsible for collecting it and for informing them. See section 10.

2.4 Photos and video

The platform supports image and video uploads attached to records throughout the product. These files may incidentally contain images of people, vehicles, and license plates. We do not analyze them, run facial recognition on them, or extract information from them.

2.5 Information collected automatically

When someone uses the application, we record technical information about the request — including IP address, browser and device type, and timestamps — to operate the service, keep it secure, and diagnose problems.

On our website, the picture is different. washup.solutions uses third-party analytics and marketing services that record the pages you visit, how you arrived, how long you stay, your approximate location, and your browser and device type, and that assign an identifier so return visits can be recognized. If you later submit one of our forms, our marketing tools associate that browsing history with you as a contact. Our forms are also protected by an automated-abuse service that examines your IP address, browser characteristics, and how you interact with the page in order to distinguish people from scripts.

2.6 When you contact us, request a trial, or book a call

Our website has forms for requesting a trial, making an inquiry, and contacting support, and we use a third-party scheduling service for demos, onboarding sessions, and calls. Between them these collect your name, contact details, company information, details about your business such as its size and type, and whatever you write in your message. Our site search records the terms you enter.

If you contact us directly by email or phone, we receive whatever you send.

We use this to respond to you, follow up about WashUp, and keep a record of the conversation.

2.7 Billing

We do not process or store payment card details. Payments are handled by our payment provider. We hold billing contact information and subscription details for each location.

2.8 Categories of personal information

Several state privacy laws ask us to describe what we handle by category. Over the past twelve months we have collected the following and disclosed each to service providers for business purposes only. We have not sold or shared any of it for advertising.

  • Identifiers — name, email address, phone number, postal address, account and visitor identifiers, IP address
  • Customer records — contact and employment-related details, billing contact information
  • Commercial information — subscription and billing history, services requested
  • Internet or network activity — sign-in and activity timestamps, browser and device type, requests to our systems; on our website, pages visited and referring site
  • Vehicle information — vehicle identification and description in incident records
  • Audio, visual, or similar — photos and video uploaded to the platform; chat, voice, and video calls
  • Employment information — role, schedule, shifts, time off, task and inspection activity
  • Inferences — our marketing tools record which pages a website visitor viewed and may use that to gauge interest in WashUp. We draw no inferences about anyone inside the application.

We do not collect Social Security numbers, driver's license numbers, financial account numbers, precise geolocation, biometric information, health information, or information about racial or ethnic origin, religion, sexual orientation, or union membership. We do not knowingly collect sensitive personal information as those laws define it.

3. Cookies and device storage

Our website and our application use cookies differently.

Our website uses cookies that are necessary to operate the site, plus cookies set by third-party analytics, marketing, scheduling, and abuse-prevention services. These record how the site is used and, where you identify yourself through a form, connect that activity to you. Those providers may use what they collect for their own purposes under their own privacy policies.

Our application sets a single session cookie. It is cryptographically signed, identifies your session and the account and locations you can access, and is required for the application to work. It persists until you sign out or clear it; closing your browser does not end your session.

The application sets no advertising or cross-site tracking cookies.

Other information stored on your device. The application saves small amounts of information in your browser's local storage — interface preferences, and drafts of notes as you type them so that work is not lost. Drafts remain on your device until submitted or cleared, and are not transmitted to us until you submit them.

You can view, block, and delete cookies and local storage through your browser settings, and major analytics providers offer their own opt-out tools. Blocking the session cookie will sign you out of the application.

4. How we use information

  • To create and operate accounts and authenticate users
  • To provide the product's features
  • To send operational notifications according to each user's settings
  • To provide support and respond to inquiries
  • To monitor reliability and performance, diagnose problems, and protect the platform against misuse
  • To understand how our website and product are used, and to follow up with people who ask about WashUp
  • To bill customers and manage subscriptions
  • To meet legal obligations and enforce our agreements
  • For any other purpose we describe to you when the information is collected

We do not sell personal information. We do not run advertising campaigns targeting individuals, and we do not market to the employees or claimants whose information our customers place in the platform.

5. Who we share information with

We share personal information with service providers that perform functions on our behalf. They may use it only to perform that function for us, and are bound by confidentiality and security terms. The categories are:

  • Hosting and infrastructure — running our application, databases, file storage, and background processing
  • Website hosting and forms — operating our marketing site and receiving what you submit through it
  • Communications — delivering email, push notifications, and in-app chat and video calling
  • Analytics and monitoring — measuring how our website and product are used, and detecting errors and outages
  • Marketing and contact management — managing inquiries and following up with people who ask about WashUp
  • Scheduling — booking demos, onboarding sessions, and calls
  • Payment processing — handling subscription billing
  • Security and abuse prevention — protecting our forms and systems

Development and testing. To build and test the service, we use copies of production information in non-production environments and on the workstations of our developers. Identifying details are masked in this process for most, but not all, record types.

We also disclose information when required by law or legal process — including in response to a subpoena, court order, or law enforcement request — to protect rights, property, or safety, and to advisors or counterparties in connection with a merger, acquisition, or sale of assets. Following any such transaction, the information remains governed by the privacy policy in effect when it was collected, unless you are notified otherwise.

We may also disclose information with your permission.

We do not sell personal information to anyone.

6. How long we keep information

We keep personal information for as long as we need it for the purpose we collected it, and afterward as long as we need it to meet legal obligations, resolve disputes, maintain security, and keep accurate business records. In practice that means:

  • Account information is kept while the account is active. Deleting a user deactivates the account and preserves the record so that an administrator can restore it and so historical activity remains attributable.
  • Records of work performed in the platform — inspections, tasks, schedules, incidents, and the notes attached to them — are kept for as long as the customer's account is active, because they are the customer's operating history.
  • Change history documenting who altered what and when is retained to support accountability and dispute resolution.
  • Messages and calls are retained by our communications providers under their settings. Deleting an account deactivates the associated chat identity, but messages that person sent remain visible to others in their channels.
  • Technical logs, monitoring data, and backups are kept for limited operating periods set by us and by the providers that hold them.
  • Inquiries, form submissions, and scheduling records are kept while we may reasonably need them to respond and follow up.

One thing worth stating plainly. When an incident record is deleted, it is removed from the active system, but a record of its previous contents — including the claimant's name, contact details, and vehicle identifiers — is retained in our change history. We do not currently operate a schedule on which that history is erased.

If you want information deleted, see section 8. We will delete what we are able to and tell you what we must keep and why.

7. Security

We use administrative, technical, and physical safeguards appropriate to the information we hold. These include one-way cryptographic hashing of credentials, role-based access controls that limit users to their assigned company and locations, separation of each customer's information, logging of changes to records, encrypted connections, and limiting access to production systems to authorized personnel. Our staff can access a customer's account to provide support.

We review these measures as the product develops. No system is completely secure, and we cannot guarantee the security of information transmitted to us.

8. Your choices and rights

Depending on where you live, you may have the right to request access to your personal information, correction of inaccurate information, deletion, a copy in a portable format, and to opt out of the sale or sharing of your information. We do not sell or share personal information for advertising, so no opt-out is needed for that.

If you have a WashUp account, you can view and correct your own profile in the application. For deletion, contact your company's administrator or us.

If you are an employee of a business that uses WashUp, contact your employer first. They control the information about you in the platform, and we will assist them in responding.

If you are named in an incident report, see section 10.

Getting a copy of your information. Administrators at your company can export records of their users and of activity in the platform. For anything beyond that, contact us and we will assemble it for you.

Making a request. Email contact@washup.solutions or write to us at the address in section 15. We will verify your identity before acting, and will respond within the time applicable law requires — generally within 45 days, with an extension where the law permits and we tell you we need it. An authorized agent may make a request on your behalf with proof of authorization. We will not treat you differently for exercising these rights.

If we decline a request, we will tell you why. You may appeal by replying to our response or writing to us at the address in section 15, and we will review the decision and respond in writing. If we deny the appeal, you may contact your state attorney general.

Notification settings. Account holders can control which operational notifications they receive in the application's settings. Essential messages — password resets, confirmations, and account or billing notices — cannot be turned off while an account is active.

Website tracking and marketing email. You can limit website tracking through your browser's cookie settings and through opt-out tools offered by analytics providers. Email we send about WashUp includes an unsubscribe link; unsubscribing stops those messages but not operational notifications.

9. Where information is stored

WashUp is operated from the United States and intended for use in the United States. Our application, database, and file storage are located in the United States. Some service providers may process information outside the United States in the course of operating their own services.

If you access the Services from the European Union or another region whose data protection laws differ from those of the United States, you are transferring your information to the United States for storage and processing, and by providing it you consent to that transfer.

10. Incident reports and vehicle owner information

This section is for people who filed or were named in a vehicle damage claim at a car wash that uses WashUp.

The car wash recorded your name, contact details, and vehicle information in our software as part of handling that claim. The car wash — not WashUp — decides what is collected and why, and is responsible for informing you. We store and process that information on their behalf.

If you want to know what is held about you, have it corrected, or have it deleted, contact the car wash where the incident occurred. If you do not know how to reach them, contact us at section 15 and we will identify the business and pass on your request.

We do not use this information for any purpose other than providing the service to that business. We do not sell it, market to you, or combine it with information from other sources.

11. Minors

WashUp is workforce software and is not directed to children. We do not knowingly collect information from anyone under 13.

Employees at car washes may include people aged 14 to 17, and a customer may create accounts for them. We do not collect date of birth and cannot determine a user's age. Customers are responsible for complying with the laws that apply to employing and managing minors, including any parental notice or consent their jurisdiction requires.

If you believe a child under 13 has an account, contact us and we will delete it.

12. Security incidents

If we become aware of a breach of security affecting personal information, we will notify affected customers without undue delay and cooperate with them in meeting their own notification obligations. Where the law requires us to notify individuals or regulators directly, we will.

13. Third-party services

Our website and application may link to services we do not operate. This policy does not apply to them and we are not responsible for their practices. Review their policies before providing information to them.

14. Our commitments to customers

Where we handle information on a customer's behalf — their employees' records and the incident records they create — we commit to the following:

  • We process that information only to provide the service and as the customer instructs. We do not use it for our own purposes and we do not sell it.
  • We make it available to the customer's authorized administrators and provide the tools to correct and delete it.
  • We use service providers in the categories listed in section 5, and will provide the current list on request.
  • We require personnel with access to production systems to keep the information confidential.
  • We will notify the customer without undue delay if we become aware of a breach affecting their information.
  • On termination, we will delete or return the customer's information on request, subject to the retention described in section 6.

Customers are responsible for determining what information they place in WashUp, for having the authority and lawful basis to do so, and for informing the people that information concerns.

We will post any revised version on this page and update the "Last updated" date above. If we make a material change to how we use personal information, we will notify account holders by email or through the application. We encourage you to review this policy periodically.
